Acceptable Use Terms & Conditions

General Terms

Host1 provides a variety of hosting services, including web hosting, mail hosting and database services. By using these services, you agree to be bound by the terms and conditions; you agree to indemnify and hold harmless Host1 from any loss, liability, claim, damage and expense arising from or related to your content or use of any services provided by Host1. If you are not satisfied with these terms and conditions then you must discontinue use of our hosting services.

Host1 may revise these terms and conditions from time to time by posting a new version of this document on our site (http://host1.com.au). Any new version of these terms will be effective from the customer's next service renewal date.

You accept legal responsibility for use of the account, are at least 18 years of age or (if younger) have your parent's or legal guardian's permission before using our services.

The hosting services must not be used for unlawful purposes. Any use of these services which violates any local, state, federal or international laws applicable to Host1, your jurisdiction, or any jurisdiction that your site is subject to is strictly prohibited.

Host1 does not tolerate SPAM. If you use, send or facilitate the sending of spam, unsolicited emails or message board posting, or any other similar methods, then your services may be immediately suspended.

Host1 reserves the right to take action, including legal or suspension of or termination of a service, against a customer who interferes with the rights of another user online, or attempts to interfere with the smooth running of the internet or Host1's services. We reserve the right to discontinue, without refund or notice, any account or service where usage of the account or service is deemed to be an abuse, and we will charge the customer for costs incurred by any such abuse.

You are responsible for any misuse of our services, even for example, if the misuse was committed by a friend, family member, guest, employee or customer with access to your account or website. You are also responsible for any such misuse regardless of whether it was with or without your consent. Therefore, you must take steps to ensure that others do not gain unauthorised access to your account or website.

Host1 reserves the right to refuse or discontinue service to anyone at our sole discretion upon 7 days notice. Your access to all or part of our services may be denied without notice if Host1 believes any of the terms and conditions have been violated.

Host1 will automatically renew your hosting service, and 14 days prior to expiry of such service shall rebill a customer's credit card, where credit card details have been provided. You acknowledge that if you do not wish to continue with your hosting service, it is your responsibility to either request cancellation of your service or disable the auto-rebill setting for your account.

You understand that you must maintain your own copy of any content published via a Host1 service and that Host1 should never be used as single copy of any critical content. Host1 has a number of systems and procedures in place to protect our system data and the data of our customers. These systems are for our own use only, i.e. in case of server failure.

You understand that no intellectual property rights are assigned to you in the use of a service provided by Host1 unless otherwise specifically contracted.

Likewise none of your intellectual property rights are assigned to Host1 via the use of a service provided by Host1 unless otherwise specifically contracted.

 

Additional Cloud Server Terms

Host1 provides access to servers instances in our cloud. Each instance has it's own allocation of resources based on the plan you chose. The Host1 Cloud Server products are a specifically packaged set of physical resources and software. Host1 will take responsibility for ensuring that your cloud servers is operational, connected to the internet and that the primary services, being HTTP, FTP, MAIL and MySQL, are fully functional. Any extra services installed by us or the customer is not guaranteed to perform to any specific level unless we expressly provide such a guarantee to the individual customer.

Each Cloud Server has a specific monthly data allowance that covers inbound and outbound data on all ports. Your total monthly inbound data cannot exceed 10% of your total allocation.

 

Service Level Guarantee

Host1 provides a 99.99% uptime guarantee on our services as per following terms:

The uptime guarantee applies to all web services, i.e. http, https and MySQL and to network connectivity. In other words, we guarantee that our web servers will always be responsive and reachable by general internet users. The guarantee does NOT apply to scheduled maintenance periods.

In addition to the above uptime guarantee, we also have a $1,000 Outage Cover applicable to CS100 customers. The $1,000 cover is in the form of a $1,000 payment to the customer and is applicable if the customer's entire server is deemed down or unoperational for a period of 5 hours or more during any single business day. The 5 hour timeframe starts from the time we are notified by the customer of the outage. The cover payout is limited to once per month.
